General conditions
The terms outlined below will be applied to the lease contract between the guests and BeTuscany who will act as an agent and will be liable only as such. The rentals of the holiday homes that BeTuscany provides will always follow the following terms and conditions that constitute the contractual basis between the owner of the holiday home and the tenant. The terms of the lease will be valid only if presented in writing and if signed by both parties.
Assumptions for the lease
Before the start of the holiday, the tenant must receive a lease contract containing the necessary instructions to reach the holiday home and to be able to collect the keys.

Terms
2.1 Check in and check out
The check-in and check-out hours will be indicated in the lease contract. Guests can make arrangements for different hour schedules directly with BeTuscany.
The established and preferential day to check in and out is Saturday. In fact, all rental periods and related prices are on a weekly basis (Saturday to Saturday). For any exceptions it is necessary to agree well in advance with BeTuscany.

The holiday homes
3.1 The size of the holiday homes
The square meters of the houses were supplied directly by the owner of the building.
3.2 Number of guests
The number of allowed guests depends on the capacity of the holiday home itself. All holiday homes, with some exceptions, can accommodate the number of guests for which they have been designed. All guests must be registered in the “Booking Form” contained in the lease agreement, including children (regardless of their age).
If the holiday home will be occupied by more people than the maximum number allowed, the owner of the holiday home or BeTuscany will have to inform the tenants that they will have time up to 12 hours to get back in line with the number of guests allowed. Penalty: cancellation without any reimbursement of the lease contract.
In addition, the owner of the holiday home and / or BeTuscany can refuse a group that has not completed the "Booking Form" in a proper way, or who has not communicated the actual number of guests well in advance from the start of the vacation. In this case, the owner of the holiday home or BeTuscany can request an extra fee for each extra guest and a mandatory final cleaning.
3.3 Tents and caravans
It is forbidden to pitch tents or install caravans in the holiday home surroundings. The owner of the holiday home and Be Tuscany will immediately request their removal. If the tenant does not comply with these instructions immediately, the owner of the holiday home and / or Be Tuscany can terminate the rental contract with immediate effect and to kick out all tenants without further notice and without any repayment of the rental rate.
3.4 Animals and allergies
Pets are allowed depending on the holiday home. In any case always ask if you can take them with you well in advance. Penalty: cancellation of the lease without any refund.
3.5 Recently built holiday homes
Some recently built holiday homes may have few plants or a poor garden due to still undergoing settling.
3.6 Noise
Depending on the area where the holiday homes are located, guests may experience noise from streets, playgrounds or construction sites. Neither the owner of the holiday home nor BeTuscany can be considered responsible for disturbing noises unless they exceed the norms of tolerability provided by the Italian Civil Code.
3.7 Swimming pools
For security reasons, guests must follow the instructions provided by the owner of the holiday home or by BeTuscany for the use of the swimming pools in some holiday homes. Guests are directly responsible for any use of the swimming pool and children must not access the swimming pool area without an adult supervision. The owner of the holiday home and BeTuscany declines all responsibility for any damage to persons.

Payment of the rent
Depending on the property selected, in order to confirm their reservation will have to pay the non-refundable BeTuscany percentage directly to the agency.
Subsequently, guests will have to pay a deposit of 30% of the rental price upon the acceptance of the rental agreement directly to the owner of the property within 3/5 days of receiving the contract (penalty: invalidity of the contract and cancellation of the booking). The customer must pay the balance 8 weeks before his arrival; the reservation will therefore be considered canceled if the full payment is not received in time and will be able to withhold the deposit already paid.
In the event that the booking of a holiday home is made 8 weeks (or less) before the arrival of the guests, the latter will have to pay the full amount of the rental before their arrival. Penalty: invalidity of the contract.
Guests, if they wish, can activate an insurance with ADAR which covers cases in which the reservation is canceled or interrupted for just cause (duly justified) with a small increase in the rental price

Cancellation and / or modification of the reservation
The tenant has the right to cancel the booking only upon payment of cancellation fees. Cancellations must be made in writing.
The cancellation costs are as follows:
1) In case of cancellation up to 8 weeks before the start date of the rental period:
- the cancellation fee is equal to the deposit, or 30% of the rental price
2) In case of cancellation from 8 weeks before the start date of the rental period up to the date of arrival or later:
- the cancellation fee is equal to the entire amount of the rental price
3) Early departure constitutes the cancellation of the booking and guests are not entitled to any refund except for cases with motivated cause (in case BeTuscany has to contact ADAR)
In case of cancellation or modification of the booking, the tenant must first inform BeTuscany by email and in case of request for reimbursement the tenant must directly contact the ADAR insurance.

Heating
The use of heating is controlled by regulations that vary from region to region. As an indication, heating appliances can be switched on between November and April. -
Security deposit
At the discretion of the owner of the holiday home, the latter at the arrival of guests may request a security deposit to be paid that will act as a deterrent in the event that the guests cause damage to the property or refuse to pay some extra costs (such as cleaning or linen supply). The amount of the security deposit depends on the size and services of the property and will be shown on the lease contract and on the online description of the property. If the amount of damages exceeds the deposit the tenant will have to refund them. -
Final cleaning
The tenant must leave the house clean.The house must be left in the conditions in which the tenant would like to find it. Although guests have to pay for the final cleaning of the apartment, this does not make them exempt from the obligation to wash the dishes, empty the refrigerator, throw away the garbage and tidy up the house before leaving. -
Damage
The tenant will have to treat the holiday home responsibly. The tenant must return the holiday home in the same condition in which he received it. The tenant is liable to the owner of the holiday home for any damage caused to the holiday home and / or his inventory during the stay by the tenant or others who have had access to the accommodation. Any damage to the holiday home and / or its inventory during the stay must be reported immediately to BeTuscany. The owner of the holiday home or BeTuscany will check the premises at the end of each location to ascertain that damage has been caused or not. -
Defects and complaints
No later than 72 hours prior to arrival, guests may present defects or complaints to the owner of the holiday home and / or BeTuscany. In order to find a satisfactory solution, the tenant must contact BeTuscany by telephone at: +39 389 3133271.
The tenant must help to avoid the worsening of any damage or defects and must help to limit as much as possible the damage to protect the property. In the event of a claim, the tenant must give BeTuscany a reasonable time to remedy any damage.
The early departure before the end of the stay without prior agreement with BeTuscany will be at the charge and at the risk of the tenant. The tenant risks not being able to terminate the lease and also risks losing the right to compensation and a reduction in price because the tenant prevents BeTuscany from remedying or repairing the damage or offering the transfer in another holiday home. BeTuscany reserves the right to remedy any claim by transferring the tenant to another holiday home at a similar price and quality, if possible. This decision will be made at the discretion of BeTuscany. If, in the opinion of the tenant, the complaint does not lead to a satisfactory solution during the stay, the complaint must be forwarded in writing to BeTuscany for further processing no later than 14 days after the end of the stay. BeTuscany will not accept claims based on the fact that other tenants have received a better holiday rental than described on the Internet. BeTuscany will always try to satisfy any specific desire, such as the location where the holiday home is located but no guarantees are offered.
Any liability for damages must only include direct and financial damages. Neither the owner of the holiday home nor BeTuscany can be held responsible for any indirect damage (consequential damage) or any non-economic damage (non-pecuniary loss).

Technical installations
Many properties have washing machines, dishwashers, microwaves, VCRs, satellite TV, dishes, freezers, sunbeds, swimming pools, jacuzzis and other services. Because these things are made available to the tenant free of charge, the tenant cannot make claims for damages or unexpected interruptions. The same applies to installations of pipes and sanitary installations. In such cases, the tenant must inform Be Tuscany about the situation so that BeTuscany can ask the owner of the holiday home to arrange the repair as soon as possible. -
Terms of BeTuscany
BeTuscany provides the rental of holiday homes without being the owner. The responsibilities and obligations therefore depend exclusively on the owner of the holiday home. BeTuscany protects the interests of the owner of the holiday home in relation to the completion of a lease contract. If, contrary to Be Tuscany's expectations, a rental can not be completed for reasons beyond BeTuscany's capacity (such as sale by court order) or a violation by the owner of the holiday home, BeTuscany will have the right to cancel the private writing with the owner and repay the leases made to interested guests. As an alternative, Be Tuscany will be able to offer the renter another holiday home. -
Resolution of conflicts
The appropriate venue in case of possible conflicts will be the judicial district where the holiday home is located, which refers to the legislation of the country in question. -
Events of force majeure
If guests cannot stay due to events that cannot be foreseen at the time of signing the contract (such as conflicts, natural disasters, pollution, epidemics, border closures, traffic conditions, interruption of currency trading) BeTuscany will have to cancel the lease. In case of force majeure events, Be Tuscany will have to reimburse the rental fee or the deposits paid to guests.
In case of theft, the owner of the holiday home and / or BeTuscany declines all responsibility. -
Other information
15.1 Change in terms of lease
If the tenant makes a special agreement, written with BeTuscany that varies from normal rental terms in one way or another, the other rental conditions of Be Tuscany will still be valid.
15.2 Order of the leases
The holiday homes are rented in the order in which they were booked.
15.3 Resolution Errors
BeTuscany cannot be considered responsible for photo and printing resolution errors.
